1. Welcome — Let's Set Some Ground Rules

Thanks for being here. These Terms of Service are the agreement between you and DivineWellnessPlus — the folks behind this website. They explain the rules for using our site, buying our products, and being part of our community.

By browsing, shopping, or creating an account with us, you're agreeing to these terms. If anything here doesn't sit right with you, we understand — but we ask that you not use our services until you're comfortable with them.

We tried to write this in plain English. Legal language is necessary sometimes, but you deserve to know what you're agreeing to without a translator.

2. Who Can Use This Site

Our products are for adults. By using our services, you confirm that:

  • You're at least 18 years old
  • You have the legal capacity to enter into this agreement
  • If you're representing a company, you have the authority to bind that company to these terms

If you're not 18 yet, we're flattered by your interest in wellness, but please come back when you're old enough to make this official.

3. Your Account

Creating an account

Some features require an account — tracking orders, saving addresses, getting faster checkout. When you create one, please give us accurate information. Fake emails and made-up addresses don't help anyone, especially when we're trying to ship you a massage chair.

Keeping it secure

You're responsible for keeping your login credentials safe. Don't share your password. If you suspect someone else has accessed your account, let us know immediately and we'll lock it down.

What we expect

All activity under your account is your responsibility. If someone uses your account to order a cold plunge, that's on you unless you reported the unauthorized access to us first.

4. Orders and Payment

Product availability

We do our best to keep everything in stock, but sometimes demand surprises us. All products are subject to availability. If we can't fulfill your order, we'll let you know as soon as possible and offer a refund or alternative.

Pricing

Prices can change. We try to keep them stable, but manufacturing costs, shipping rates, and other factors sometimes force our hand. We won't charge you more than what was shown at checkout when you placed your order, even if the price changes later.

How to pay

We accept:

  • Visa
  • MasterCard
  • PayPal
  • Apple Pay
  • Google Pay

All payments are processed securely through Shopify Payments. Your billing information must be accurate and up to date.

Order acceptance

We reserve the right to refuse or cancel orders for reasons including:

  • The product is out of stock
  • There's an error in the description or price
  • We suspect fraudulent or unauthorized activity

If we cancel an order, we'll refund your payment in full and explain why.

5. Shipping and Delivery

Please see our Shipping Policy for full details on delivery times, costs, and procedures.

Important: Once we hand your package to the carrier, the risk of loss or damage passes to you. We insure every shipment, but the carrier becomes responsible for the physical package at that point. If something goes wrong in transit, we'll help you resolve it, but the legal liability shifts when the carrier takes possession.

6. Returns and Refunds

We want you to be happy with your purchase. Please see our Return and Refund Policy for the full details on how returns, exchanges, and refunds work.

The short version: You have 30 days, we accept returns for both defective and non-defective items (with conditions), and we'll work with you to make it right.

7. Intellectual Property — What's Ours and What's Yours

What we own

Everything on this website — the text, images, logos, product descriptions, and design — belongs to DivineWellnessPlus or our partners. It's protected by copyright, trademark, and other intellectual property laws. We worked hard to build this, and we ask that you respect that work.

What you can do

We grant you a limited, non-exclusive license to use our site for personal, non-commercial purposes. Browse, shop, read our blog posts — that's all encouraged.

What you can't do

Please don't:

  • Copy, reproduce, or resell our content without permission
  • Use our trademarks or brand name in hidden text or meta tags without our consent
  • Try to scrape our site or bypass our security measures
  • Use our content for commercial purposes without a written agreement

If you want to use our content for something legitimate — a review, a feature, a partnership — just ask. We're reasonable people.

If you submit a review, photo, testimonial, or any other content to us, you grant us permission to use it. We might feature your review on our site, share it on social media, or use it in marketing. We won't claim we wrote it — you'll always get credit — but we need the right to share it.

As-is basis

Our website and services are provided on an "as is" and "as available" basis. We do our best to keep everything accurate, up to date, and running smoothly, but we're human. Sometimes things break, descriptions have typos, or a product sells out before we can update the page.

No guarantees

We don't guarantee that:

  • Our site will meet every specific need you have
  • Our site will be uninterrupted, error-free, or perfectly secure
  • The results you get from using our products will match what someone else experienced

Wellness is personal. Our products are designed to support recovery, but individual results vary. We can't promise outcomes.

11. Limitation of Liability

To the fullest extent permitted by law, DivineWellnessPlus, our team members, and our partners won't be liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits or lost data
  • Damages arising from your use or inability to use our services
  • Issues caused by unauthorized access to our servers
  • Interruptions in service or transmission problems

This doesn't limit our liability for gross negligence, willful misconduct, or anything that can't be limited under applicable law. We're not trying to dodge responsibility for genuine harm we cause — we're just setting realistic boundaries.

12. Indemnification

If your actions on our site cause us legal trouble, you agree to help cover our costs. Specifically, you agree to indemnify and hold harmless DivineWellnessPlus from claims, damages, or losses arising from:

  • Your use of our services
  • Your violation of these terms
  • Your violation of someone else's rights (intellectual property, privacy, etc.)

Basically: if you do something that gets us sued, you're responsible for the fallout.

13. Termination

We can terminate or suspend your account at any time, without prior notice, if you breach these terms or engage in conduct that we believe harms our business or community. We'll always try to be fair about it, but we reserve the right to act quickly if necessary.

If we terminate your account, any outstanding orders will be handled according to our policies. If you're owed a refund, you'll still get it.

14. Governing Law

These terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. If we ever end up in a legal dispute, Georgia courts will be the forum.

15. Dispute Resolution — Let's Talk First

Try to work it out informally

If a dispute arises, both of us agree to try to resolve it informally first. Contact us at support@divinewellnessplus.com within 30 days of the issue arising. Give us a chance to make it right before lawyers get involved.

Mediation and arbitration

If we can't resolve it informally, we'll settle it through binding arbitration under the American Arbitration Association rules. Arbitration will happen in Georgia, and the arbitrator's decision is final.

No class actions

We agree to resolve disputes individually. Neither of us will participate in class action lawsuits, consolidated proceedings, or representative actions against the other.

Small claims exception

Either of us can still bring a claim in small claims court if it qualifies, or seek an injunction for intellectual property violations.

16. Changes to These Terms

We may update these terms from time to time as our business evolves. Changes take effect immediately when posted on this page. It's your responsibility to review them periodically. If you keep using the site after changes are posted, you're accepting the updated terms.

For significant changes, we'll do our best to make them obvious. But the bottom line is: check this page occasionally if you want to stay current.

17. The Fine Print

Severability

If any part of these terms is found to be unenforceable, the rest stays in effect. We intended every provision to be valid, but if a court says one part doesn't work, the rest of the agreement remains binding.

Entire agreement

These terms, together with our Privacy Policy, Shipping Policy, and Return Policy, represent the entire agreement between us regarding our services. They supersede any prior agreements or understandings.

Waiver

If we don't enforce a particular right or provision right away, that doesn't mean we've waived it. We can choose to enforce it later. We're not giving up any rights by being patient or lenient.
